Canadians - Recover Your Taxes On Winnings
According to the
Canada USA tax treaty, a Canadian resident can offset their
gambling losses against their
gambling wins which are reported on IRS form 1042-S.
Gambling losses in the United States from ANY gambling activity (such as casino losses, non-winning horse racing & dog racing wagering tickets, non-winning US lottery tickets, bingo losses, etc.) can be used to decrease your
taxes on winnings. Generally, most people have more
gambling losses in a given year than gambling winnings, and as such, usually a full refund for the withheld tax can be claimed back.
International Visitors To The United States - Reclaim Your Taxes On Gambling Wins
Besides the
Canada USA tax treaty, the US has a tax treaty with many other foreign countries. If you are a resident of any one of the following countries, your gambling income is not taxable by the United States and thus you will be eligible for a refund if you were subject to any gambling withholding tax:

If you are a resident from a country other than those on the above list, then you cannot claim back any tax withheld on your gambling income.
IRS Refund Requirements
In order for us to help you claim back your
taxes on winnings, you will need to fulfill the following IRS refund requirements:
1. Be a US non-resident at the time of the
gambling win.
2. Provide proof of your US non-resident status:
Original or certified copy (from the issuing passport office, the U.S. Embassy or a U.S. notary) of a valid and current passport.
Alternatively, you can submit your original or certified copy (from the issuing agency, the U.S. Embassy or a U.S. notary) of a driver's license AND birth certificate OR citizenship card. At least one piece of identification must have a photo, and all identification must be current and not expired. Birth certificates are considered to be current identification as there is no expiry date on the document.
If you submit your original identification documentation to us, we will review and notarize the documentation and send it back to you immediately by registered mail.
Please note that certified copies of identification documents from non-U.S. notaries (i.e., Canadian notaries) are NOT accepted.
3. Have
taxes on winnings withheld by a USA casino or other gaming facility.
4. File
gambling wins only for the past 3 years.
5. Provide the 1042-S IRS tax form from the USA casino or gaming establishment that withheld your taxes.
The 1042-S IRS form states the amount of withholding tax that was withheld from your gambling win.

6. Have US
gambling losses in the same year as your US
gambling wins to claim against your gambling winnings.
Gambling losses can only be deducted up to the amount of the
gambling winnings. You cannot deduct gambling losses that are more than your gambling winnings.
